Terms of Service
Effective September 8, 2026 · Last updated September 21, 2026
These terms are the agreement between you and Sublime Design NV LLC, 5747 Garriga St, Las Vegas, NV 89135 (“FieldMetriq”, “we”) covering your use of the FieldMetriq software and website. By creating an account or using the service, you agree to them.
1. What the service is
FieldMetriq is job-management software for contractors: leads, job walks, estimates, proposals, invoices, scheduling, and the reporting around them. We may add, change, or remove features over time. If we remove something you depend on, we will give you reasonable notice.
2. Your account
- You must be at least 18 and able to enter a contract.
- Give us accurate information and keep it current.
- You are responsible for what happens under your account, including anything your team members do. Keep your password to yourself and tell us promptly at support@fieldmetriq.com if you think someone else has gotten in.
3. Subscriptions, trials, and payment
- Paid plans are billed in advance on a recurring basis through Stripe. The plan you pick at signup sets the price and the billing period.
- Free trials, where offered, convert to a paid subscription at the end of the trial unless you cancel first.
- Subscriptions renew automatically until you cancel. Cancel any time; your subscription runs to the end of the period you already paid for.
- Fees already paid are non-refundable except where the law requires otherwise, or where we agree in writing.
- We may change pricing with at least 30 days' notice before it applies to you.
4. Your data belongs to you
Everything you put into FieldMetriq — your clients, your jobs, your photos, your numbers — is yours. You keep all rights to it.
You grant us a limited licence to store, process, transmit, and display that content strictly to operate the service for you, and to make backups. That licence exists only to run the software and ends when you delete the content or close your account.
We do not sell your data, and we do not use your business data to train AI models. How we handle data is described in full in our Privacy Policy, which forms part of these terms.
5. Acceptable use
Do not use FieldMetriq to:
- break the law, or help someone else break it
- upload content you do not have the right to upload
- send messages to people who have not agreed to receive them — you are responsible for having consent before you text or email a client through FieldMetriq
- attempt to breach, overload, probe, or reverse-engineer the service
- resell or white-label the service without our written agreement
We may suspend an account that is causing harm to the service or to other users. Where we reasonably can, we will contact you first.
6. Text messages (SMS program)
The FieldMetriQ transactional SMS program is operated by Sublime Design NV LLC, 5747 Garriga St, Las Vegas, NV 89135.
Call to action / opt-in. You opt in by providing a mobile number to FieldMetriQ and agreeing to these terms:
- On a FieldMetriQ account, for account notifications, including verification texts.
- When you request or book a job, for job scheduling messages about that job.
- When you agree with your contractor to receive texts about your job, for job scheduling and portal invites. Your contractor records that agreement when they save your number.
Message types under this program are:
- Job scheduling
- Portal invites
- Account notifications
Message frequency varies. Msg & data rates may apply.
Reply STOP to opt out. Reply HELP for help. For help from us, email support@fieldmetriq.com.
Consent to receive these messages is not a condition of purchase. You can decline texts and still use FieldMetriQ.
How phone numbers and message content are handled is in our Privacy Policy (https://fieldmetriq.com/privacy). These terms are published at https://fieldmetriq.com/terms.
7. Third-party connections
FieldMetriq connects to services like Google Calendar, Stripe, and Twilio when you choose to enable them. Those services have their own terms and their own privacy policies, and your use of them is between you and that provider. We are not responsible for a third-party service being unavailable, changing, or discontinuing.
8. Availability
We work to keep FieldMetriq available and to warn you before planned maintenance, but we do not promise uninterrupted service. We are not liable for downtime caused by things outside our reasonable control — hosting providers, network outages, or third-party APIs.
9. Disclaimers
FieldMetriq helps you produce estimates, proposals, and cost figures. Those outputs are tools, not professional advice. You are responsible for checking every number before you give it to a client or rely on it to price a job. We do not provide legal, tax, accounting, or licensing advice.
Except where the law does not allow it, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent the law allows, FieldMetriq is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data.
Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow these limits, so they may not apply to you.
11. Ending the agreement
- You can close your account at any time by emailing support@fieldmetriq.com.
- We may end or suspend your account if you materially breach these terms and do not fix it within 14 days of us telling you.
- Before your account closes, you can ask us for an export of your data. After closure we delete it as described in the Privacy Policy.
- Sections 4, 9, 10, and 12 survive termination.
12. Governing law
These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Clark County, Nevada, and both of us consent to that jurisdiction.
13. Changes to these terms
We may update these terms. If a change materially affects your rights, we will give you at least 30 days' notice in the app or by email. Continuing to use FieldMetriq after a change takes effect means you accept it.
